Our German Patent Attorneys are admitted to practice in Germany and are members of the German Patent Attorneys Association (Patentanwaltskammer), which is the supervisory authority responsible for them.
Our Irish Patent Agents are admitted to practice in Ireland and are on the register of Irish Patent Agents held by the Irish Patents Office. They are also a member of the German Patent Attorneys Association, which is the responsible supervisory authority.
Our European Patent Attorneys are admitted before the European Patent Office (EPO) and are members of the Institute of Professional Representatives before the European Patent Office (epi).
Our German Attorneys-at-Law are admitted to practice in Germany and are members of the Munich Bar Association (Rechtsanwaltskammer München), which is the supervisory authority responsible for them. The German attorneys at law are also admitted representatives at the European Union Intellectual Property Office (EUIPO) in Alicante, Spain.
Our Solicitors are members of The Law Society of England & Wales and of the Munich Bar Association, which is the responsible supervisory authority.
Rules of Professional Conduct
German Patent attorneys are subject to the professional rules stipulated by the German Patent Attorney Code (Patentanwaltsordnung, PAO) and the Professional Code of Conduct for Patent Attorneys (Berufsordnung der Patentanwälte). They are also members of the ‘Fédération Internationale des Conseils en Propriété Industrielle’ (FICPI) and are subject to its code of professional conduct. All regulations about the professional rules for patent attorneys are accessible via the websites of the Patent Attorneys Association, FICPI and epi.
The following professional rules also apply for Irish Patent Agents practicing in Germany: The Law on Patent Attorneys (PAO), the Federal Regulations for Patent Attorneys. In addition Irish Patent Agents are subject to the Patents Act 1992 and the rules implemented thereunder.
European Patent Attorneys are subject to the Code of Conduct of the Institute of Professional Representatives before the European Patent Office.
The following professional rules apply for German Attorneys-at-Law: The Federal Lawyers’ Act (BRAO), the Rules of Professional Practice Lawyers (BORA), the Law on the Remuneration of Attorneys (RVG), the Rules and Regulations for Specialized Lawyers (FAO), the Professional Code for Lawyers of the European Community (CCBE) and the Law Regulating the Activity of European Lawyers in Germany (EuRAG). Information about the professional rules for Attorneys-at-Law s are accessible via the national bar association`s website.
Our Solicitors are subject to the IPReg Code of Conduct, to the SRA Code of Conduct 2011 and the professional rules which apply for German Attorneys-at-Law.
The rules governing conduct do not allow our attorneys (whether attorneys-at-law or patent attorneys) to represent conflicting interests. For this reason, we seek to ascertain before confirming representation whether there is a conflict of interest.
Professional Liability Insurance
The professional liability insurance is provided by Zurich Insurance plc, Niederlassung für Deutschland, Platz der Einheit 2, 60327 Frankfurt/Main. The territorial coverage of the insurance extends to worldwide activities and is in accordance with the requirements of Sec. 51 Federal Lawyers’ Act and Sec. 45 Law on Patent Attorneys.
